1. Acceptance of Terms

By using Conversta’s platform, website, or services, you agree to these Terms.

2. Services

Conversta provides: AI SMS messaging (A2P / 10DLC), Voice calls and live transfer, Ringless voicemail, Workflow automation, Lead engagement tools.

3. SMS & VOICE CONSENT

By submitting your phone number, you consent to receive: SMS messages, Phone calls (manual and automated), Voicemail messages.

Message frequency varies. Reply STOP to opt out or HELP for assistance.

4. 10DLC COMPLIANCE

All messaging must comply with: TCPA, CTIA guidelines, Carrier rules (T-Mobile, AT&T, Verizon). Clients must: Maintain opt-in records, Use compliant language, Avoid misleading content.

5. Account Responsibility

Users are responsible for all activity and compliance.

6. Prohibited Use

You may not: Send spam or unsolicited messages, Mislead recipients, Violate telecom laws, Use purchased or scraped lists.

7. Call Recording

Calls may be recorded for compliance and quality.

8. Limitation of Liability

Conversta is not liable for: Carrier filtering, Delivery delays, Lost revenue.

9. Termination

Accounts may be suspended for violations.

10. Governing Law

California law governs these Terms.

Privacy Policy

1. Information Collected

We collect: Name, phone, email, Device/IP data, SMS and call data, Client-uploaded lead data.

2. Use of Information

Used to: Deliver communications, Operate platform, Improve AI systems, Ensure compliance.

3. Communication Monitoring

Messages and calls may be: Logged, Recorded, Analyzed for compliance.

4. Data Sharing

Shared with: Carriers and telecom providers, SMS/voice vendors, Legal authorities if required.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties, except for aggregators and service providers necessary to deliver the text messaging service.

5. Data Retention

Data retained as needed for: Service delivery, Legal compliance.

6. Security

We use: Encryption, Secure infrastructure, Access controls.

7. User Rights

Users may: Request access, Request deletion, Opt out of messaging.

Acceptable Use Policy (AUP)

1. Overview

This policy governs all messaging and communication activity on Conversta.

2. Required Practices

Clients must: Obtain express written consent, Include opt-out language, Identify themselves clearly, Honor opt-outs immediately.

3. Prohibited Content

You may NOT send: Spam or unsolicited outreach, False or misleading claims, Deceptive financial offers, Illegal products/services, Harassment or abusive messages.

4. High-Risk Categories (Strictly Controlled)

Lending / financial services, Direct lending, Debt relief, Political messaging. These must follow all applicable regulations.

5. Message Practices

Messages must: Be conversational, Avoid spam triggers, Match opt-in expectations.

6. Enforcement

Violations may result in: Message blocking, Account suspension, Termination.

Data Processing Agreement (DPA)

1. Roles

Client = Data Controller, Conversta = Data Processor

2. Scope

Conversta processes data to: Send SMS, Route calls, Automate communication workflows.

3. Data Types

Contact data, Communication data, Behavioral data.

4. Security Measures

We implement: Encryption in transit and at rest, Access controls, Monitoring systems.

5. Subprocessors

Conversta may use: SMS carriers, Voice providers, Cloud infrastructure.

6. Compliance

We comply with: GDPR (where applicable), CCPA, TCPA.

7. Data Breach

In case of breach: Clients will be notified promptly, Remediation steps will be taken.

8. Data Deletion

Upon request or termination, data may be deleted or returned.
